These Terms and Conditions ("Terms") govern your access to and use of mortgage-related websites, social-media pages, advertisements, lead forms, messaging channels, appointment systems, mortgage-readiness resources, application portals, and related communications made available by Peter Irungu in connection with Groves Capital Inc.
In these Terms, "Company," "we," "us," and "our" refer to Groves Capital Inc and Peter Irungu only to the extent each is responsible for the applicable service or communication. "You" and "your" refer to any person who accesses or uses a covered service.
By accessing or using a covered service, submitting information, scheduling an appointment, communicating with us, or proceeding to a mortgage-readiness or mortgage-application platform, you acknowledge that you have reviewed and agree to these Terms and the applicable Privacy Policy.
You represent that you are at least 18 years old, legally capable of agreeing to these Terms, and using the services for lawful purposes. If you do not agree, do not submit information or use the services.
A visit, social-media interaction, general inquiry, or preliminary conversation does not by itself create a lender-borrower relationship, mortgage-broker engagement, fiduciary relationship, real-estate agency relationship, or commitment to provide a loan.
Services may vary by state, loan program, lender, property, licensing status, investor requirements, market conditions, and the information provided by the consumer.
Mortgage services are offered only where Groves Capital and the applicable mortgage loan originator are appropriately licensed, sponsored, authorized, exempt, or otherwise permitted to operate. Based on current business information, lending services may be available in Alabama, Arizona, Arkansas, California, Colorado, Florida, Idaho, Illinois, Indiana, Iowa, Michigan, Minnesota, Nebraska, New Mexico, Ohio, Oregon, Pennsylvania, South Carolina, Tennessee, Texas, Virginia, Washington, and Wyoming.
Availability of an advertisement or website in a location does not mean services are offered in every jurisdiction. Inquiries from other states may be declined or referred to an appropriately licensed professional. Product availability may differ even in licensed states.
These Terms apply to general online, social-media, lead-generation, and preliminary services. They do not replace or modify any transaction-specific document, including a mortgage application, credit authorization, broker agreement, Loan Estimate, Closing Disclosure, rate-lock agreement, electronic-consent disclosure, financial privacy notice, adverse-action notice, promissory note, deed of trust, mortgage, servicing disclosure, lender commitment, or state-required notice.
If a valid transaction-specific document conflicts with these Terms, that document controls the subject matter of the conflict to the extent permitted by law.
Peter Irungu may assist with mortgage origination through Groves Capital, but may not be the creditor, underwriter, investor, loan servicer, appraiser, title insurer, escrow agent, settlement attorney, consumer-reporting agency, insurer, or final credit decision-maker. Independent parties are responsible for their own decisions, professional judgments, systems, fees, timelines, privacy practices, security, and legal obligations.
A referral, introduction, link, or exchange of contact information does not create a partnership, joint venture, guarantee, or assumption of an independent party's liabilities.
Unless a duly authorized lender issues a separate written commitment, nothing in an advertisement, website, readiness report, calculator, prequalification, preapproval, email, text message, social-media communication, or consultation constitutes a commitment to lend or a guarantee of:
All mortgage transactions remain subject to application, verification, underwriting, lender and investor requirements, property review, applicable law, and satisfaction of all conditions.
A mortgage-readiness or prequalification assessment may rely partly or entirely on information supplied by you and may not include a credit report, income verification, asset verification, automated underwriting, appraisal, title review, insurance review, or final lender review.
A preapproval is ordinarily conditional and may be withdrawn, revised, or expire if information is inaccurate, documentation is incomplete, market conditions change, the selected property is unacceptable, or there is a material change in credit, employment, income, debt, assets, occupancy, or other relevant circumstances. A preapproval letter is not a guarantee that a lender will fund a loan.
Rates, annual percentage rates, points, lender credits, fees, loan limits, mortgage-insurance requirements, and product eligibility may change without notice. A rate is not locked unless an authorized party confirms the lock in writing under applicable procedures.
Any advertised or discussed scenario depends on stated or unstated assumptions, which may include credit profile, loan amount, loan-to-value ratio, property type, occupancy, location, income, debt, assets, loan purpose, term, lock period, discount points, and market conditions.
We do not guarantee the lowest rate, lowest cost, or best terms available in the market. Consumers may compare offers from other providers and should review all formal disclosures carefully.
Specific credit terms used in advertising are intended to reflect terms actually available when published and must be accompanied by legally required, clear, and conspicuous disclosures. No general disclaimer cures a materially false or misleading advertisement.
Unless expressly and accurately stated, neither Peter Irungu nor Groves Capital is a government agency or acting on behalf of a government agency. References to FHA, VA, USDA, or another government-related program describe possible loan programs and do not imply government endorsement of Peter Irungu or Groves Capital.
Down-payment assistance, grants, bond programs, subsidies, and special lending programs may be limited by funding, geography, income, purchase price, property type, homebuyer education, occupancy, repayment terms, participating-lender requirements, and other conditions. Availability and eligibility are not guaranteed.
You agree that information and documents you provide will be truthful, accurate, complete, current, authentic, lawfully obtained, and not materially misleading. You authorize reasonable reliance on information you submit unless we know or reasonably should know that it is incorrect.
You must promptly report material changes, including changes in employment, income, debt, credit, assets, source of funds, occupancy, property selection, purchase price, marital status where legally relevant, bankruptcy, liens, judgments, lawsuits, tax obligations, or other circumstances that could affect a mortgage transaction.
You may not submit altered, fabricated, fraudulent, or misleading records, impersonate another person, conceal material facts, misrepresent occupancy or source of funds, gain unauthorized access, interfere with security, upload malicious code, scrape systems, or use the services for unlawful purposes.
Where permitted by law, suspected fraud, identity theft, unauthorized access, or material misrepresentation may result in suspension, termination, additional verification, preservation of records, referral to Groves Capital compliance, withdrawal from a transaction, or disclosure to lenders, regulators, law enforcement, insurers, or other authorized parties.
A consumer report is not obtained merely because you view a website or social-media page. A credit report or credit-related information may be obtained when a permissible purpose exists and the legally required authorization or consent has been provided.
An inquiry may be soft or hard depending on the service, vendor, authorization, and stage of the mortgage process. Credit information may change, and we do not control the data or scoring methodology used by consumer-reporting agencies, score providers, lenders, or underwriting systems.
The services do not constitute credit-repair services and do not promise removal of accurate negative information, a particular score increase, or approval within a specified period.
Home Qualifiers, available at partner.homequalifiers.com, may be used for credit evaluation and homebuyer-readiness services. It may collect or process contact, income, employment, debt, housing, and credit-related information under its own terms, authorizations, and privacy practices.
The LendingPad application portal, available at the LendingPad application portal, may be used to complete and process a mortgage application. It may collect highly sensitive information, including Social Security numbers, income, employment, assets, liabilities, credit information, identity documents, property information, and electronic signatures.
Third-party platforms are independently operated. Their terms, privacy notices, security measures, retention practices, uptime, calculations, and system decisions may apply in addition to these Terms. We do not control every independent act or omission of a third party.
Meta and other social-media platforms are independently operated. Your use of those platforms is governed by their own terms and privacy practices. Lead information submitted through Meta may be used only for the disclosed mortgage-related purpose and related follow-up, subject to applicable consent and law.
Do not send Social Security numbers, bank-account numbers, passwords, tax returns, pay statements, identity documents, complete credit reports, or other highly sensitive information through public comments, ordinary social-media messages, or unsecured channels. Use an approved secure portal when requested.
We may remove or restrict unlawful, fraudulent, threatening, defamatory, discriminatory, infringing, spam, malicious, irrelevant, or privacy-invasive content on a business-controlled social-media page.
By providing contact information, you authorize reasonable communications related to your inquiry, appointment, requested service, application, or transaction. Marketing communications will be sent only as permitted by law and the consent presented at the point of collection.
Where supported, you may opt out of marketing text messages by replying STOP and may unsubscribe from marketing emails using the provided mechanism. Opting out of marketing does not prevent legally required, security-related, or transaction-related communications.
Message and data rates may apply. Electronic messages may be delayed, blocked, intercepted, misdirected, or viewed on a shared device. Do not assume that a document was accepted, a condition was cleared, a rate was locked, or a closing was approved unless confirmed through an appropriate written or platform-based communication.
You may be asked to consent separately to electronic records and signatures. Clicking an acceptance button, checking a box, entering a verification code, typing a name, or applying an electronic signature may create a binding electronic record when applicable requirements are satisfied.
A transaction-specific electronic-consent disclosure may govern hardware and software requirements, paper copies, withdrawal of consent, and document delivery. That disclosure controls over any inconsistent general statement in these Terms.
You are responsible for protecting account credentials, verification codes, email accounts, telephone devices, and access to shared devices. Use unique passwords and multifactor authentication when available, and notify the appropriate provider promptly of suspected compromise.
Be alert to phishing, spoofed telephone numbers, fraudulent websites, fake social-media profiles, altered payment instructions, and persons falsely claiming to represent Peter Irungu or Groves Capital. Independently verify material requests through trusted contact information.
No electronic system is completely secure. We do not guarantee that every security incident, unauthorized access attempt, transmission error, or third-party compromise can be prevented.
Never send money based solely on an email, text message, social-media message, or unexpected telephone instruction. Before transferring funds, independently confirm instructions with the intended title company, escrow company, closing attorney, lender, or other authorized recipient using a trusted telephone number obtained independently.
Peter Irungu and Groves Capital are not responsible for funds sent to an unauthorized recipient through fraudulent, compromised, altered, or unverified instructions not issued or authorized by them, except to the extent responsibility cannot legally be excluded.
Calculators, readiness tools, debt-to-income estimates, affordability estimates, projected payments, cash-to-close estimates, artificial-intelligence tools, and automated summaries are preliminary and may contain errors or rely on incomplete assumptions.
They do not constitute a Loan Estimate, appraisal, credit decision, underwriting approval, rate lock, commitment to lend, or guarantee. Final calculations and decisions are made through applicable lender, underwriting, and transaction processes.
Mortgage eligibility depends on both the borrower and the property. Financing may be restricted because of condition, appraisal, property type, zoning, legal use, acreage, utilities, access, flood status, insurance availability, title defects, condominium eligibility, manufactured-home requirements, environmental concerns, repairs, or investor rules.
An informal value discussion is not an appraisal. We do not control an independent appraiser's opinion, the appraised value, title findings, insurance decisions, or a lender's acceptance of a property.
Any processing or closing timeline is an estimate. Delays may arise from incomplete documents, verification, appraisal, title, insurance, government processing, underwriting conditions, repairs, seller issues, market volume, technology outages, fraud review, or events outside reasonable control.
Do not schedule movers, terminate a lease, transfer utilities, make nonrefundable purchases, or rely on a proposed closing date until the authorized transaction parties confirm the closing.
Mortgage information is not legal, tax, accounting, investment, appraisal, title, insurance, credit-repair, or real-estate advice. You should consult appropriately licensed or qualified professionals for those matters.
Unless a separate written real-estate representation agreement is executed, use of the services does not create a buyer-agency, seller-agency, brokerage, property-management, or fiduciary relationship.
A recommendation or referral does not guarantee a provider's price, quality, availability, performance, licensing, security, or suitability. Independent providers remain responsible for their own services and conduct.
You are not required to use a particular settlement-service provider solely because the provider was recommended, except where applicable law permits selection to protect a lender's interest. Any affiliated-business relationship or required-use arrangement will be separately disclosed when required.
No prohibited referral fee, kickback, or unearned fee will knowingly be paid or accepted.
Mortgage-related costs may include credit-report, appraisal, flood, tax-service, title, escrow, recording, government, origination, discount-point, insurance, prepaid-interest, reserve, and other transaction-specific charges. Formal estimates and disclosures govern actual transaction costs.
An early estimate may change if the loan program, loan amount, property, rate, documentation, or third-party charges change, or if another legally permitted changed circumstance occurs.
Submitting an inquiry, lead form, readiness questionnaire, or preliminary information does not obligate you to complete an application, accept a loan, purchase a property, use a particular lender or provider, or continue receiving marketing communications.
Receipt of an inquiry does not obligate us or any lender to accept an application, provide particular terms, approve a loan, or continue processing where discontinuation is legally permitted.
Unless otherwise stated, website and social-media content, graphics, logos, videos, photographs, reports, forms, calculators, software, page designs, and branding are owned by or licensed to Peter Irungu, Groves Capital, or their providers.
You receive a limited, revocable, nonexclusive, nontransferable license to use public content for personal, lawful, noncommercial purposes. You may not republish, sell, scrape, mirror, reverse engineer, remove ownership notices, create misleading derivative works, impersonate the Company, or use protected content to create a competing service without authorization.
Testimonials describe individual experiences and do not guarantee similar results. If you submit public content, you represent that you have the right to submit it and that it is not unlawful, misleading, infringing, defamatory, or confidential.
General, nonconfidential feedback may be used to improve the services without compensation. Separate authorization is required before using a consumer's name, image, voice, testimonial, or private transaction story in advertising where required by law.
We may modify, suspend, replace, restrict, or discontinue general online features, tools, content, and platforms at any time, subject to applicable law and transaction obligations. We do not guarantee continuous availability, compatibility with every device, error-free operation, or continued availability of any third-party service.
General content may become outdated. Consumers should request current information and review transaction-specific disclosures before making financial decisions.
Use of the services is also governed by the applicable Privacy Policy and any separate financial privacy notice. Personal information may be retained as reasonably necessary for mortgage processing, compliance, recordkeeping, fraud prevention, audits, disputes, legal claims, and other lawful purposes.
Electronic records, including form submissions, consent records, timestamps, audit trails, communications, application records, and platform logs, may be used to document acceptance, authorization, delivery, activity, and compliance to the extent permitted by law.
This disclaimer does not apply to express written promises in transaction-specific documents or to duties and warranties that cannot lawfully be disclaimed.
This limitation may include alleged losses caused by temporary unavailability, delayed communications, data-entry errors, reliance on preliminary or outdated information, market changes, third-party platform failures, independent professional decisions, a consumer's failure to verify information, or unauthorized payment instructions not issued by the Company.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, willful misconduct, unlawful discrimination, breach of a nonwaivable statutory duty, or another category of liability that applicable law does not permit to be excluded or limited.
To the fullest extent permitted by law, you agree to indemnify and hold harmless Peter Irungu, Groves Capital, and their authorized officers, employees, agents, successors, and service providers from third-party claims, losses, penalties, damages, or reasonable costs arising from your fraud, identity theft, intentional misconduct, submission of false or altered documents, unauthorized use of another person's information, malicious interference with systems, intellectual-property infringement, unlawful public content, or material breach of these Terms.
This provision does not require you to indemnify a protected party for that party's own negligence, gross negligence, willful misconduct, fraud, legal violation, or conduct for which indemnification is prohibited.
Nothing in these Terms waives or limits a right or remedy that cannot lawfully be waived, including rights under applicable mortgage, fair-lending, consumer-reporting, financial privacy, electronic-signature, telemarketing, privacy, data-security, fair-housing, and unfair-or-deceptive-practices laws.
Nothing prevents you from contacting a regulator, filing a complaint, reporting suspected unlawful conduct, participating in an investigation, responding to legal process, or exercising legally protected rights.
Before filing a nonemergency civil claim concerning general website or communication services, the parties are encouraged, but not required where prohibited, to attempt informal resolution. A written notice should identify the claimant, describe the dispute and relevant dates, include supporting documents, and state the requested resolution.
Notices may be sent to peter.irungu@grovescapital.com or to the business address listed above. This informal process does not shorten a limitation period, prevent emergency relief, restrict regulatory complaints, or waive nonwaivable rights.
These Terms are governed by applicable federal law and, where federal law does not control, by the law of the jurisdiction having the most substantial lawful relationship to the relevant consumer, property, conduct, and service. No choice-of-law or venue rule will be interpreted to deprive a consumer of a nonwaivable protection provided by applicable law.
We may restrict or terminate access to general services when reasonably necessary because of suspected fraud, unauthorized access, security risk, abuse, harassment, false information, licensing limitations, platform discontinuation, legal requirements, or material breach of these Terms.
Termination does not eliminate accrued rights, privacy obligations, record-retention duties, compliance obligations, or provisions that by their nature should survive.
To the extent permitted by law, we are not responsible for delay or failure caused by circumstances outside reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, civil unrest, government action, labor disruption, utility failure, internet or telecommunications outage, cyberattack, vendor outage, public-health emergency, court closure, recording-office delay, or comparable events. This provision does not excuse nonwaivable legal obligations.
We may assign responsibilities relating to general online services in connection with a merger, acquisition, restructuring, sale of assets, change of platform provider, or lawful business transfer, subject to continuing legal and privacy obligations. You may not transfer account access or impersonate another applicant.
Except where expressly stated, these Terms do not create rights in unrelated third parties and do not create a partnership, joint venture, employment relationship, fiduciary relationship, lender-borrower relationship, or real-estate agency relationship.
If a provision is invalid or unenforceable, it will be interpreted as narrowly as necessary to make it lawful; if it cannot be reformed, it will be severed, and the remaining provisions will remain in effect.
Failure to enforce a provision is not a continuing waiver. Headings are for convenience. "Including" means "including without limitation." No employee may orally waive a legal requirement, underwriting condition, lender policy, or written loan term unless authorized to do so.
These Terms, the Privacy Policy, any applicable Notice at Collection, communication consent, cookie notice, and documents expressly incorporated by reference form the agreement governing general online, social-media, and lead-generation services. They do not constitute the entire agreement governing a mortgage transaction, for which transaction-specific documents control.
We may update these Terms prospectively to reflect changes in services, technology, business practices, platforms, law, or regulatory guidance. Updated Terms will display a revised effective or last-updated date. Changes do not retroactively modify executed mortgage documents, create consent that was not obtained, alter a rate lock, or waive a statutory right.

These Terms are a general website, social-media, lead-generation, and mortgage-services disclosure. They are not legal advice and do not replace company compliance procedures or transaction-specific disclosures. Mortgage, advertising, privacy, telemarketing, licensing, and consumer-finance requirements may apply differently depending on the facts, state, entity, information, and transaction.
